{"data":{"id":"us-ky/krs-99.220","jurisdiction":"us-ky","citation":"KRS 99.220","heading":"Certificate of approval of condemnation.","body":"(1) When it is desired that any real property in a development area be acquired by\ncondemnation, there shall be presented to the supervising agency by the\nredevelopment corporation a verified petition requesting the issuance of a certificate\nof approval of condemnation of such real property which shall contain, among other\nthings:\n(a) A metes and bounds description or other legal description of the real property\ninvolved and a statement of the estate, interest, privilege, franchise or right\ntherein or appurtenant thereto to be condemned;\n(b) Proof that such real property is within the development area; and\n(c) Proof that certificates of approval of the development plan required by KRS\n99.040 to 99.060 have been issued.\n(2) The supervising agency shall determine within a reasonable time thereafter the truth\nor sufficiency of the statements and proof contained in such petition, and, if such\ndetermination shall be in the affirmative, the supervising agency shall issue to the\npetitioner a certificate of approval of condemnation. Such certificate shall contain a\ndescription of the real property proposed to be condemned, the facts so determined\nwith respect thereto, and a statement that the real property proposed to be\ncondemned is required for a public use and that  its acquisition for such use is\nnecessary. No condemnation proceeding to acquire real property in a development\narea, by a city for a redevelopment corporation, shall be commenced until such a\ncertificate of approval of condemnation shall have been issued.","path":["KRS Chapter 99"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26522","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:01Z","sha256":"c5a5dc1157d3f4844d56533a06d71f5c838ccb089a564f19db2efd7b2ab053fa","source_id":"us-ky","stale":false,"prev":"us-ky/krs-99.210","next":"us-ky/krs-99.230"},"notice":"GroundRules: Original legal text.
