{"data":{"id":"us-ky/krs-99.240","jurisdiction":"us-ky","citation":"KRS 99.240","heading":"Kinds of evidence admissible on question of value of condemned property --","body":"Expedition of proceedings -- Condemnation of property devoted to public use.\nThe following provisions shall apply to any proceedings for the assessment of\ncompensation and damag es for real property in a development area taken or to be taken\nby condemnation for a redevelopment corporation:\n(1) Evidence of the price and other terms upon any bona fide sale, or the rent received\nor reserved, and other terms upon any bona fide sale, option, lease or tenancy\nrelating to any of the real property taken or to be taken or to any comparable real\nproperty in the vicinity when the option, sale, or lease was given, occurred or the\ntenancy existed, within a reasonable time of the trial, shall b e admissible on direct\nexamination.\n(2) Any time during the pendency of such action or proceeding, the redevelopment\ncorporation, the city or any owner may apply to the court for an order directing any\nowner, the redevelopment corporation, or the city, as  the case may be, to show\ncause why further proceedings should not be expedited, and the court may upon\nsuch application make an order requiring that the hearings proceed and that any\nother steps be taken with all possible expedition.\n(3) For the purposes of KRS 99.010 to 99.310, the award of compensation shall not be\nincreased by reason of any increase in the value of the real property caused by the\nassembly, clearance or reconstruction, or proposed assembly, clearance or\nreconstruction for the purposes o f KRS 99.010 to 99.310 of the real property in the\ndevelopment area. No allowance shall be made for the improvements begun on real\nproperty after notice to the owner of such property of the institution of the\nproceedings to condemn such property.\n(4) Evidence shall be admissible bearing upon the insanitary, unsafe or substandard\ncondition of the premises, or the illegal use thereof, or the enhancement of rentals\nfrom such illegal use, and such evidence may be considered in fixing the\ncompensation to be pai d, notwithstanding that no steps to remedy or abate such\nconditions have been taken by the department or officer having jurisdiction. If a\nviolation order is on file against the premises in any such department, it shall\nconstitute prima facie evidence of t he existence of the condition specified in such\norder.\n(5) If any of the real property in the development area which is to be acquired by\ncondemnation has, prior to such acquisition, been devoted to another public use, it\nmay nevertheless be acquired, Provided, That no real property belonging to the city\nor to any other governmental body, or agency or instrumentality thereof, corporate\nor otherwise, may be acquired without its consent.\n(6) Upon the trial, evidence of the price and other terms upon a sale or assignment or of\na contract for the sale or assignment of a mortgage, award, proposed award, transfer\nof a tax lien or lien of a judgment relating to property taken, shall be relevant,\nmaterial and competent, upon the issue of value or damage and shall be admissible\non direct examination.\n(7) Upon the trial, a statement, affidavit, deposition, report, transcript of testimony in\nan action or proceeding, or appraisal made or given by any owner or prior owner of\nthe premises taken, or by any person on his behalf, to any court, governmental\nbureau, department or agency respecting the value of the real property for tax\npurposes, shall be relevant, material and competent upon the issue of value or\ndamage and shall be admissible on direct examination.","path":["KRS Chapter 99"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26524","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:01Z","sha256":"0f613c4ccc2a1aa942342a93e556c09589ae107ab22b822a96d31d06538d531f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-99.230","next":"us-ky/krs-99.250"},"notice":"GroundRules: Original legal text.
