{"data":{"id":"us-ky/krs-99.615","jurisdiction":"us-ky","citation":"KRS 99.615","heading":"Definitions for KRS 99.610 to 99.680.","body":"The following words or terms shall have the following meanings wherever used in KRS\n99.610 to 99.680 unless a different meaning is clearly indicated by the context:\n(1) \"Act\" means KRS 99.610 to 99.680 which may be called the \"Local Development\nAuthority Act\";\n(2) \"Technical advisory council\" means that committee appointed under the terms of\nKRS 99.655;\n(3) \"Price advisory council\" means that committee appointed under the terms of KRS\n99.680;\n(4) \"Agency\" means a development authority established by this statute in and for cities\nof the first class, cities with populations equal to or greater than fifteen thousand\n(15,000) based upon the most recent federal decennial census, a consolidated local\ngovernment, and urban-county governments;\n(5) \"Bonds\" means any  bonds, notes, interim certificates, debentures, or other\nobligations issued by an agency pursuant to the provisions and purposes of KRS\n99.610 to 99.680;\n(6) \"Project area\" means any area or specific property designated by an agency or any\narea or specifi c property actually acquired or formally proposed for acquisition by\nan agency, for historical or open space preservation purposes, or for the\ndevelopment permitted by KRS 99.610 to 99.680;\n(7) \"City\" means any city of the first class, cities with populati ons equal to or greater\nthan fifteen thousand (15,000) based upon the most recent federal decennial census,\na consolidated local government, or an urban -county government, in which an\nagency has been established;\n(8) \"Development\" means the acquisition, pl anning, designing, clearance, renovation,\nor rehabilitation of existing improvements, development, and disposal, or any\ncombination thereof, of a project area, including the preparation of such project area\nfor the development of residential, commercial, industrial, public, recreational, open\nspace, or other uses, including the preservation of existing residential, commercial,\nindustrial, public, recreational, open spaces, or other uses valued locally for their\neconomic or historical importance as may be ap propriate or necessary, in the\nopinion of the board of commissioners of an agency;\n(9) \"Subdevelopment\" means the actual construction, renovation, or rehabilitation of\nimprovements to real property including the installation of or improvement to\nexisting utilities, curbs, gutters, sidewalks, storm sewers, and other necessary works\nand improvements, consistent with the established development plan for each\nspecific project area in order to market, through private enterprise, said\nimprovements to individuals, commercial business, and industry;\n(10) \"Development plan\" means the plan for the development as defined, of all or any\npart of a project area;\n(11) \"Mayor\" means the mayor of a city as defined in this section;\n(12) \"Governing board\" means a board of alde rmen or commissioners, a legislative\ncouncil in a consolidated local government, an urban -county council, or any\nlegislative body of a city as defined in this section;\n(13) \"Project\" means any undertaking within a project area and any such undertaking\nwhich may be included in, and financed by, a single or separate financing agreement\nor bond issue;\n(14) \"Persons and families of lower income\" means persons and families who lack the\namount of income which is necessary (as determined by standards established by\nthe agency) to enable them, without financial assistance, to live in decent, safe, and\nsanitary dwellings, without overcrowding; and\n(15) \"Residential housing project\" means a specific work or improvement undertaken\nprimarily to provide or to rehabilitate dwelling accommodations for persons and\nfamilies of lower income, including the acquisition, const ruction, and rehabilitation\nof land, buildings, and improvements and such other facilities as may be incidental\nor appurtenant thereto.","path":["KRS Chapter 99"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43773","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:02Z","sha256":"a2e740ed659dc1fea4cec249b8d9c19c91fd22f574395dfc78d1c0e53443ba94","source_id":"us-ky","stale":false,"prev":"us-ky/krs-99.610","next":"us-ky/krs-99.620"},"notice":"GroundRules: Original legal text.
