{"data":{"id":"us-ky/krs-99.825","jurisdiction":"us-ky","citation":"KRS 99.825","heading":"Obligations of conservator while in possession of property -- Final plan for","body":"abatement -- Status report -- Full accounting upon implementation -- Petition\nto terminate conservatorship through sale.\n(1) While in possession of the building, the conservator shall:\n(a) Maintain, safeguard, and insure the property;\n(b) Develop a final plan for abatement of the conditions which caused the petition\nto be granted or, if no feasible final plan can be developed, develop\nalternatives, including the closin g, sealing, or demolition of all or part of the\nbuilding in accordance with KRS 99.830;\n(c) Submit the final plan to the court and all parties in interest; and\n(d) Execute the final plan.\n(2) The final plan shall include a cost estimate, a financing plan, sources of financing,\nand a description of the work to be done for the rehabilitation of the building in\norder to bring it into compliance with all applicable housing, building, and nuisance\ncode requirements, any duly adopted plan for the area in which th e building is\nlocated, and any historic preservation requirements, along with an estimated\ntimeline for completion.\n(3) Any party in interest shall be allowed to comment on or request a hearing on the\nfinal plan within thirty (30) days of receipt of the final plan by certified or registered\nmail.\n(4) While in possession of the building, the conservator shall additionally submit a\nstatus report to the court and all parties in interest every six (6) months from the\ndate of appointment, or more frequently as t he court may deem appropriate. The\nstatus report shall include:\n(a) A copy of any contracts entered into by the conservator regarding\nimprovement of the building and any related bids;\n(b) An account of all expenses and improvements;\n(c) The status of developing and implementing the final plan; and\n(d) A description of proposed actions to be taken in the next six (6) months to\nimprove the building.\n(5) Upon implementation of the final plan, the conservator shall submit to the court and\nall parties in interes t a full accounting of all actions taken to rehabilitate the\nproperty, all income and expenditures received or incurred during implementation\nof the final plan, and an estimate of the conservator's fee.\n(6) The conservator may then petition the court for a uthorization to terminate the\nconservatorship through either a public or private sale.","path":["KRS Chapter 99"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51839","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:02Z","sha256":"dc26272b62ae87b2ad0c89b34a72c3edf1bf0dcfd5fd2fe79bc18e06980cf1ce","source_id":"us-ky","stale":false,"prev":"us-ky/krs-99.820","next":"us-ky/krs-99.830"},"notice":"GroundRules: Original legal text.
