{"data":{"id":"us-ky/krs-99.830","jurisdiction":"us-ky","citation":"KRS 99.830","heading":"Plan for demolition of building -- Required evidence -- Salvage of reusable","body":"materials -- Full accounting -- Petition to terminate conservatorship through\nsale.\n(1) If no feasible final plan can be developed for rehabilitation of the buildi ng in order\nto bring it into compliance with all applicable housing, building, and nuisance code\nrequirements at a reasonable cost in relation to the present value of the building\nwithout consideration of the value of the land on which the building is loca ted, the\nconservator may submit a plan for demolition and removal of the building and all\ndebris from the property to the court and all parties in interest.\n(2) The present value of the building in relation to the estimate for costs of\nrehabilitation of the building in order to bring it into compliance with all applicable\nhousing, building, and nuisance code requirements may be established by evidence\nof three (3) affidavits prepared by real property appraisers, qualified building\ncontractors, or qualified building inspectors.\n(3) A plan for demolition shall require a reasonable effort to be made to salvage\nreusable materials for credit against the cost of demolition. The proceeds of any\nmoneys received from the sale of salvaged materials shall be used or ap plied\nagainst the cost of demolition and removal of the building and all debris from the\nproperty. Proper records shall be kept showing application of sales proceeds. Any\nsale of salvaged materials may be made without the necessity of public\nadvertisement.\n(4) Any party in interest shall be allowed to comment on or request a hearing on a plan\nfor demolition within thirty (30) days of receipt of the plan for demolition by\ncertified or registered mail.\n(5) Upon demolition and removal of the building and all d ebris from the property, the\nconservator shall submit to the court and all parties in interest a full accounting of\nall actions taken, all income and expenditures received or incurred, and an estimate\nof the conservator's fee.\n(6) The conservator may then petition the court for authorization to terminate the\nconservatorship through either a public or private sale.","path":["KRS Chapter 99"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58054","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:02Z","sha256":"ba3c5b3aa9a2bc1c34b06bf6ef3224f821a091c7b874694a13f55403286c991d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-99.825","next":"us-ky/krs-99.835"},"notice":"GroundRules: Original legal text.
