A board may employ professional, technical, and support staff to carry out its planning, oversight, and evaluation functions.\nB. A board's staff shall be separate from and independent of any workforce training provider providing workforce education in the workforce development area.\nC. The requirement for separate staffing does not preclude a board from designating a qualified organization to provide staff services to the board if the board does all of the following:\n(1) Arranges for independent evaluation of any other workforce services provided by the staffing organization.\n(2) Requests and obtains from the department a waiver of the separate staffing requirement.\nD. A request for a waiver under Paragraph (2) of Subsection C of this Section shall contain a detailed justification for the waiver, including the following:\n(1) Cost-effectiveness.\n(2) Prior experience.\n(3) Geographic or budgetary consideration.\n(4) Availability of qualified applicants.","path":["TITLE 23.
