{"data":{"id":"us-la/rs-9-4265","jurisdiction":"us-la","citation":"RS 9:4265","heading":"Default of a party","body":"Unless otherwise agreed by the parties, if, without showing sufficient cause:\n(1) The claimant fails to communicate his statement of claim in accordance with R.S. 9:4263(A), the arbitral tribunal shall terminate the proceedings.\n(2) The respondent fails to communicate his statement of defense in accordance with R.S. 9:4263(A), the arbitral tribunal shall continue the proceedings without treating the failure in itself as an admission of the claimant's allegations.\n(3) Any party fails to appear at a hearing or to produce documentary evidence, the arbitral tribunal may continue the proceedings and make the award on the evidence before it.","path":["TITLE 9.
