(a) The obligations imposed by this chapter shall apply to an insurance institution, insurance representative or insurance-support organization which in the case of life, health and disability insurance:\n(1) collects, receives or maintains information in connection with an insurance transaction which pertains to a natural person who is a resident of the commonwealth; or\n(2) engages in an insurance transaction with an applicant, individual or policyholder who is a resident of the commonwealth.\n(b) In the case of life, health or disability insurance, the rights granted by this chapter shall extend to the following residents of the commonwealth:\n(1) natural persons who are the subject of information collected, received or maintained in connection with insurance transactions; and\n(2) applicants, individuals or policyholders who engage in or seek to engage in insurance transactions.\n(c) For purposes of this section, a person shall be considered a resident of the commonwealth if such person's last known mailing address, as shown in the records of the insurance institution, insurance representative or insurance-support organization, is located in the commonwealth.","path":["Part I","Title XXII","Chapter 175I"],"source_url":"https://malegislature.gov/Laws/GeneralLaws/PartI/TitleXXII/Chapter175I/Section1","current_through":"amendments passed before May 31, 2026","vintage":"","retrieved_at":"2026-09-17T05:24:11Z","sha256":"7fb3bad6f7ef256bcd5f421c31eb4f605e9ecc3a00ff8521fdcc2e70a0fafc4f","source_id":"us-ma","stale":false,"prev":"us-ma/mass.-gen.-laws-ch.-175h-8","next":"us-ma/mass.-gen.-laws-ch.-175i-2"},"notice":"GroundRules: Original legal text.
