(a) Sections thirty-six to fifty-five, inclusive, shall apply to all time-shares subject to this chapter except as provided in subsection (b).\n(b) Neither a public offering statement nor the materials required by section forty-two need be prepared or delivered in the case of:\n(1) a gratuitous disposition of a time-share;\n(2) a disposition pursuant to court order;\n(3) a disposition by a government or governmental agency;\n(4) a disposition by foreclosure or deed in lieu of foreclosure;\n(5) a disposition that may be cancelled at any time and for any reason by the purchaser without penalty;\n(6) a disposition of a time-share in a unit situated wholly outside the commonwealth pursuant to a contract executed wholly outside the commonwealth, if there has been no offering within the commonwealth;\n(7) an offering by a developer of time-shares in no more than one time-share unit at any one time; or\n(8) A disposition of a time-share property or all time-shares therein to one purchaser.","path":["Part II","Title I","Chapter 183B"],"source_url":"https://malegislature.gov/Laws/GeneralLaws/PartII/TitleI/Chapter183B/Section36","current_through":"amendments passed before May 31, 2026","vintage":"","retrieved_at":"2026-09-17T05:24:23Z","sha256":"7ad8d4fa86de00a8b456ab1bba5e54f3cacd4556bad435f489eb6a98577756d9","source_id":"us-ma","stale":false,"prev":"us-ma/mass.-gen.-laws-ch.-183b-35","next":"us-ma/mass.-gen.-laws-ch.-183b-37"},"notice":"GroundRules: Original legal text.
