Remedies for breach of trust\n(a) A violation by a trustee of a duty the trustee owes to a beneficiary shall be a breach of trust.\n(b) To remedy a breach of trust that has occurred or may occur, the court may:\n(1) compel the trustee to perform the trustee's duties;\n(2) enjoin the trustee from committing a breach of trust;\n(3) compel the trustee to redress a breach of trust by paying money, restoring property or other means;\n(4) order a trustee to account;\n(5) appoint a special fiduciary to take possession of the trust property and administer the trust;\n(6) suspend the trustee;\n(7) remove the trustee;\n(8) reduce or deny compensation to the trustee;\n(9) subject to section 1012, void an act of the trustee, impose a lien or a constructive trust on trust property or trace trust property wrongfully disposed of and recover the property or its proceeds; or\n(10) order any other appropriate relief.","path":["Part II","Title II","Chapter 203E"],"source_url":"https://malegislature.gov/Laws/GeneralLaws/PartII/TitleII/Chapter203E/Section1001","current_through":"amendments passed before May 31, 2026","vintage":"","retrieved_at":"2026-09-17T05:24:35Z","sha256":"a885ca64ad4041b4e6e0e901705a3f1b356b6bce7932d002eec58c3b71519f48","source_id":"us-ma","stale":false,"prev":"us-ma/mass.-gen.-laws-ch.-203e-817","next":"us-ma/mass.-gen.-laws-ch.-203e-1002"},"notice":"GroundRules: Original legal text.
