Resignation of trustee\n(a) A trustee may resign:\n(1) upon at least 30 days' notice to: (i) the settlor and all co-trustees of the trust, in the case of a revocable trust, and (ii) the qualified beneficiaries and all co-trustees of the trust, in the case of any other trust; or\n(2) with the approval of the court.\n(b) In approving a resignation, the court may issue orders and impose conditions reasonably necessary for the protection of the trust property.\n(c) Any liability of a resigning trustee or of any sureties on the trustee's bond for acts or omissions of the trustee shall not be discharged or affected by the trustee's resignation.","path":["Part II","Title II","Chapter 203E"],"source_url":"https://malegislature.gov/Laws/GeneralLaws/PartII/TitleII/Chapter203E/Section705","current_through":"amendments passed before May 31, 2026","vintage":"","retrieved_at":"2026-09-17T05:24:35Z","sha256":"afbda9942e3422a15d9eadce77a343b12843704e73c1f606058db9ffb703a4f2","source_id":"us-ma","stale":false,"prev":"us-ma/mass.-gen.-laws-ch.-203e-704","next":"us-ma/mass.-gen.-laws-ch.-203e-706"},"notice":"GroundRules: Original legal text.
