(a) Whoever, being under 21 years old, plays, places wagers at or collects winnings from, whether personally or through an agent, a game in a gaming establishment shall be punished by a fine not to exceed $1,000.\n(b) Whoever, being a gaming licensee or an employee of a gaming licensee, who knowingly allows a person under the age of 21 to play, place wagers at, or collect winnings from a game in a gaming establishment, whether personally or through an agent, shall be punished, for a first offense, by imprisonment in the house of correction for not more than 1 year or a fine not to exceed $10,000, or both, and in the case of a person other than a natural person, by a fine not to exceed $500,000 and, for a second or subsequent offense, by imprisonment in the house of correction for not more than 2 years or a fine not to exceed $50,000, or both, and in the case of a person other than a natural person, by a fine not to exceed $1,000,000.\n(c) Whoever knowingly plays, places wagers at or collects winnings from a game in a gaming establishment for or on behalf of a person under 21 years of age shall be punished by imprisonment in a house of correction for not more than 6 months or by a fine of not more than $1,000 or both.","path":["Part I","Title II","Chapter 23K"],"source_url":"https://malegislature.gov/Laws/GeneralLaws/PartI/TitleII/Chapter23K/Section43","current_through":"amendments passed before May 31, 2026","vintage":"","retrieved_at":"2026-09-17T05:20:08Z","sha256":"9e3cacebd17f8dfd001ecc78a192b1e682f0727ea6bf74cd63a83a32e8513664","source_id":"us-ma","stale":false,"prev":"us-ma/mass.-gen.-laws-ch.-23k-42","next":"us-ma/mass.-gen.-laws-ch.-23k-44"},"notice":"GroundRules: Original legal text.
