No licensee shall be granted more than 3 marijuana retailer licenses, 3 medical marijuana treatment center licenses, 3 marijuana product manufacturer licenses or 3 marijuana cultivator licenses; provided, however, that a licensee may hold 3 marijuana retailer licenses, 3 medical marijuana treatment center licenses, 3 marijuana product manufacturer licenses and 3 marijuana cultivator licenses.\n[ Text of section as amended by 2026, 65, Sec. 36 effective April 19, 2026. For text effective until April 19, 2026, see above.]\nSection 16. (a) No licensee shall be granted more than 6 marijuana retailer licenses, 3 fully integrated medical marijuana treatment center licenses, 3 marijuana product manufacturer licenses or 3 marijuana cultivator licenses; provided, however, that a licensee may hold 6 marijuana retailer licenses, 3 fully integrated medical marijuana treatment center licenses, 3 marijuana product manufacturer licenses and 3 marijuana cultivator licenses; and provided further, that a licensee that holds 3 fully integrated medical marijuana treatment center licenses shall not hold any additional medical marijuana establishment licenses established by the commission pursuant to section 7 of chapter 94I.\n(b) The limitations of subsection (a) shall not apply to: (i) a person functioning solely as a trustee during or after the sale of a marijuana establishment or medical marijuana establishment to a licensee's employees through an employee stock ownership plan as defined in section 407(d)(6) of the Employee Retirement Income Security Act of 1974, 29 U.S.C. 1107(d)(6); or (ii) a person or entity that possesses a financial interest in the form of equity in a license of less than 20 per cent; provided, however, that such person or entity does not otherwise have direct or indirect control over the operations of a license.","path":["Part I","Title XV","Chapter 94G"],"source_url":"https://malegislature.gov/Laws/GeneralLaws/PartI/TitleXV/Chapter94G/Section16","current_through":"amendments passed before May 31, 2026","vintage":"","retrieved_at":"2026-09-17T05:22:13Z","sha256":"4a50ff47867504d42345bbc1d5085c218b15c81c38a9a38bafb0df8908135b91","source_id":"us-ma","stale":false,"prev":"us-ma/mass.-gen.-laws-ch.-94g-15","next":"us-ma/mass.-gen.-laws-ch.-94g-17"},"notice":"GroundRules: Original legal text.
