Code, Agriculture § 5–210.4","heading":"","body":"(a) The Secretary may bring an action for an injunction against a person who violates any provision of this subtitle.\n(b) In an action for an injunction under this section, any finding of the Secretary after a hearing is prima facie evidence of each fact the Secretary determines.\n(c) On a showing that a person is violating any provision of this subtitle, a court shall grant an injunction without requiring a showing of a lack of an adequate remedy at law.\n(d) An action for an injunction under this section is in addition to, and not instead of, criminal prosecution taken under § 5-211 of this subtitle or imposition of civil penalties under § 5-210.2 of this subtitle.","path":["Article - Agriculture"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gag\u0026section=5-210.4","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:55:53Z","sha256":"625d7e5b0e2143a7c16726e1e8768193df65bc2ecf1c943e63706f7a996c2920","source_id":"us-md","stale":false,"prev":"us-md/md.-code-agriculture-5-210.3","next":"us-md/md.-code-agriculture-5-211"},"notice":"GroundRules: Original legal text.
