Code, Agriculture § 5–406","heading":"","body":"(a) If the Secretary, in cooperation with the local health authority, finds that a person is causing or allowing mosquitoes to breed or develop on any property in a manner that may pose a threat to public health, the Secretary may order that the person abate the mosquito habitat in a manner and at a time specified in the order.\n(b) After all reasonable attempts of abatement have failed, an order issued in accordance with subsection (a) of this section shall be served:\n(1) On the person who is causing or allowing mosquitoes to breed or develop; or\n(2) If the person who is causing or allowing the mosquitoes to breed or develop cannot be found, on the owner or occupant of the property where the mosquitoes exist.","path":["Article - Agriculture"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gag\u0026section=5-406","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:55:53Z","sha256":"fac0efdecd9479d24dc0f566af9d874e9ba97b129622e603b1bd1beec014d78d","source_id":"us-md","stale":false,"prev":"us-md/md.-code-agriculture-5-405.1","next":"us-md/md.-code-agriculture-5-407"},"notice":"GroundRules: Original legal text.
