Code, Agriculture § 8–8A–12","heading":"","body":"(a) In addition to any other action authorized under this subtitle, the Department may impose administrative penalties up to $5,000 per day, not to exceed $50,000 in total penalties, for a violation of this subtitle, regulations adopted under this subtitle, or any condition of the permit.\n(b) The penalty shall be assessed with consideration given to:\n(1) The willfulness of the violation;\n(2) The extent to which the existence of the violation was known to the violator but uncorrected by the violator;\n(3) The extent to which the violator exercised reasonable care;\n(4) The extent to which the violation resulted in actual harm to the environment or to human health or safety;\n(5) The nature and degree of injury to or interference with general welfare, health, and property;\n(6) The extent to which the current violation is part of a recurrent pattern of the same or similar type of violation committed by the violator; and\n(7) The extent to which the violation creates the potential for harm to the environment or to human health or safety.","path":["Article - Agriculture"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gag\u0026section=8-8A-12","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:55:53Z","sha256":"cf6ae74501f577b075376adbadb62399e43bb57de4abe51e5452f3f48877fc81","source_id":"us-md","stale":false,"prev":"us-md/md.-code-agriculture-8-8a-11","next":"us-md/md.-code-agriculture-8-8a-13"},"notice":"GroundRules: Original legal text.
