Code, Alcoholic Beverages and Cannabis § 1–411","heading":"","body":"(a) (1) In this section the following words have the meanings indicated.\n(2) “Authorized instructor” means an instructor at a qualified institution of higher education who:\n(i) teaches a course or program in enology, fermenting, brewing, or hospitality and tourism; and\n(ii) is at least 21 years old.\n(3) “Qualified institution of higher education” means an institution of postsecondary education that:\n(i) generally limits enrollment to graduates of secondary schools;\n(ii) awards degrees at the associate, baccalaureate, or graduate level; and\n(iii) offers courses or programs in enology, fermenting, brewing, or hospitality and tourism.\n(4) “Qualified student” means a student who is:\n(i) at least 18 years old and under the age of 21 years; and\n(ii) enrolled in a course or program in enology, fermenting, brewing, or hospitality and tourism offered by a qualified institution of higher education.\n(5) (i) “Taste” means to draw an alcoholic beverage into the mouth.\n(ii) “Taste” does not include swallowing or otherwise consuming an alcoholic beverage.\n(b) A qualified student may taste an alcoholic beverage if:\n(1) the qualified student:\n(i) tastes the alcoholic beverage:\n1. for educational purposes as part of a course or program in enology, fermenting, brewing, or hospitality and tourism that the qualified student is enrolled in at a qualified institution of higher education; and\n2. only during the dates and times of the enology, fermenting, brewing, or hospitality and tourism course or program; and\n(ii) spits the alcoholic beverage out after tasting the alcoholic beverage;\n(2) an authorized instructor offers the alcoholic beverage only during the dates and times of the enology, fermenting, brewing, or hospitality and tourism course or program; and\n(3) the alcoholic beverage remains under the control of an authorized instructor.\n(c) A qualified institution of higher education is not required to obtain a permit or license issued under this article to allow a qualified student to taste an alcoholic beverage in accordance with this section if the qualified institution does not impose an extra fee or charge for the alcoholic beverage tasted by a qualified student.","path":["Article - Alcoholic Beverages and Cannabis"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gab\u0026section=1-411","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:03Z","sha256":"9d6ff5be7cb26ac16368fb8a5199b84a32fb3ef8cffa2f8858a05b48738a487b","source_id":"us-md","stale":false,"prev":"us-md/md.-code-alcoholic-beverages-and-cannabis-1-410","next":"us-md/md.-code-alcoholic-beverages-and-cannabis-2-101"},"notice":"GroundRules: Original legal text.
