Code, Alcoholic Beverages and Cannabis § 18–1304","heading":"","body":"(a) In this section, “Festival” means the Charles County Beer and Wine Festival.\n(b) There is a Charles County Beer and Wine Festival (CBWF) license.\n(c) The Board may issue the license to a holder of a retail license, Class 3 winery license, or Class 4 limited winery license.\n(d) The license authorizes the holder to display and sell:\n(1) wine that is:\n(i) manufactured and processed in any state; and\n(ii) distributed in the State when the license application is filed; and\n(2) beer that is brewed by a brewer:\n(i) that brews less than 60,000 barrels of beer annually; and\n(ii) whose product is distributed in the State when the license application is filed.\n(e) A license holder may display and sell beer and wine:\n(1) at retail for on– and off–premises consumption; and\n(2) during the hours and days designated for the Festival.\n(f) (1) Subject to paragraph (3) of this subsection, the Board may choose 1 weekend, Friday through Sunday inclusive, each year for the Festival.\n(2) The Board shall:\n(i) choose a location that is not licensed; and\n(ii) ensure that the primary focus of the Festival is the promotion of Maryland beer and wine.\n(3) The weekend chosen for the Festival may not:\n(i) be within 14 days before or after the dates selected for the Maryland Wine Festival in Carroll County; or\n(ii) conflict with the dates selected for the:\n1. Anne Arundel County Beer and Wine Festival;\n2. Baltimore County Wine Festival;\n3. Calvert County Wine Festival;\n4. Harford County Wine Festival;\n5. Howard County Wine Festival;\n6. Queen Anne’s County Beer and Wine Festival;\n7. Maryland Wine Festival in Somerset County;\n8. Cumberland and Shenandoah Valley Wine Festival in Washington County; or\n9. Worcester County Beer and Wine Festival.\n(g) The license holder may hold another license of a different class or nature.\n(h) Beer and wine displayed and sold shall be:\n(1) invoiced to the license holder by a wholesaler, Class 3 winery, or Class 4 limited winery; and\n(2) delivered to the Festival from the licensed premises of the wholesaler, Class 3 winery, or Class 4 limited winery.\n(i) A holder of a wholesale, Class 3 winery, or Class 4 limited winery license may enter into an agreement with the license holder to:\n(1) deliver beer and wine not earlier than 2 days before the effective date of the festival license; and\n(2) accept returns not later than 2 days after the expiration date of the festival license.\n(j) The Board may set the license fee.\n(k) The Board shall adopt regulations to carry out this section.","path":["Article - Alcoholic Beverages and Cannabis"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gab\u0026section=18-1304","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:03Z","sha256":"3681b921b0d24ac4cfc6e14c1977e5a1ab031b74b67482b07765b35d19fc069e","source_id":"us-md","stale":false,"prev":"us-md/md.-code-alcoholic-beverages-and-cannabis-18-1301","next":"us-md/md.-code-alcoholic-beverages-and-cannabis-18-1307"},"notice":"GroundRules: Original legal text.
