Code, Alcoholic Beverages and Cannabis § 18–1602","heading":"","body":"(a) (1) Except as provided in subsection (b) of this section, the Board may not issue a license:\n(i) with an on–sale privilege, for an establishment that is within 500 feet of a school accredited by the State Board of Education; or\n(ii) with an off–sale privilege, for an establishment that is within 1,000 feet of a school accredited by the State Board of Education.\n(2) The distance from the establishment to the school is to be measured in a direct line from the nearest wall of the establishment to the property line of the school.\n(b) The prohibition against issuing a license in subsection (a) of this section does not apply to:\n(1) a Class B (on–sale) beer, wine, and liquor license issued for an establishment located in a municipality in the county;\n(2) a school that locates its building within 500 feet of an existing licensed premises; or\n(3) the renewal or transfer of a license issued before May 1, 2014.","path":["Article - Alcoholic Beverages and Cannabis"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gab\u0026section=18-1602","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:03Z","sha256":"377639307d72f76bafe1e650dbc665223690f68a8dbd051481af95c0a586d895","source_id":"us-md","stale":false,"prev":"us-md/md.-code-alcoholic-beverages-and-cannabis-18-1601","next":"us-md/md.-code-alcoholic-beverages-and-cannabis-18-1605"},"notice":"GroundRules: Original legal text.
