Code, Alcoholic Beverages and Cannabis § 22–1001.1","heading":"","body":"(a) There is a Class B–BB (bed and breakfast) beer, wine, and liquor license.\n(b) The Board may issue the license to a license holder who is approved by the appropriate local governmental unit to operate a bed and breakfast that:\n(1) provides services ordinarily provided by a bed and breakfast;\n(2) has at least one room but not more than 10 rooms, each with sleeping accommodations, excluding resident management quarters, that the public for consideration may use for a specified time; and\n(3) has a kitchen facility that has been approved by the appropriate local governmental unit.\n(c) The license authorizes the license holder to sell beer, wine, and liquor to a guest if:\n(1) the name and address of the guest appears on the registry that the bed and breakfast maintains; and\n(2) the guest is an occupant of a sleeping room in the bed and breakfast.\n(d) The license authorizes the license holder to sell beer, wine, and liquor for on–premises consumption to a guest of a catered event at the bed and breakfast if:\n(1) the license holder is under contract to cater the event;\n(2) the license holder caters the event; and\n(3) food is served at the catered event.\n(e) The license holder may sell beer, wine, and liquor for on–premises consumption during the hours and days as set out for a Class B beer, wine, and liquor license under § 22–2004 of this title.\n(f) The license does not authorize the sale of beer, wine, and liquor to an individual who:\n(1) is not a guest of the bed and breakfast; or\n(2) is registered as a guest at the bed and breakfast only to obtain beer, wine, and liquor.\n(g) (1) A bed and breakfast may not be operated only to sell or provide beer, wine, and liquor.\n(2) If the bed and breakfast ends operations as a bed and breakfast:\n(i) the license is void; and\n(ii) the license holder shall return the license to the Board.\n(h) The Board shall adopt regulations to:\n(1) carry out this section; and\n(2) ensure that the primary purpose of the license is to allow the license holder to operate a bed and breakfast.\n(i) The annual license fee is $1,000.","path":["Article - Alcoholic Beverages and Cannabis"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gab\u0026section=22-1001.1","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:03Z","sha256":"44ac6f76f3bc76422eccd552b794110c81905c9cf3e4e0d2748892bdd32fe5f3","source_id":"us-md","stale":false,"prev":"us-md/md.-code-alcoholic-beverages-and-cannabis-22-1001","next":"us-md/md.-code-alcoholic-beverages-and-cannabis-22-1002"},"notice":"GroundRules: Original legal text.
