Code, Alcoholic Beverages and Cannabis § 22–805","heading":"","body":"(a) There is a Class B Cafe beer and wine license.\n(b) (1) The Board may issue the license for use by a cafe if:\n(i) the Board determines that the cafe has adequate tables, chairs, food, and facilities for preparing and serving meals;\n(ii) the average gross monthly receipts from the sale of cooked or prepared food served at the cafe and other items approved by the Board exceed 50% of the average monthly receipts from the sale of beer and wine sold for on–premises consumption; and\n(iii) not more than 10% of the total square footage of the cafe is dedicated to the public display of beer and wine that are offered for sale.\n(2) The Board shall set a maximum and a minimum seating capacity for the cafe.\n(3) The license:\n(i) authorizes the license holder to sell beer and wine 7 days a week at a cafe, at retail, at the place described in the license, for on– and off–premises consumption;\n(ii) has a wine tasting privilege for on–premises consumption for every day of the year; and\n(iii) may be used for off–premises catering.\n(c) The Board shall set the maximum number of cafe licenses that it may issue under this section.\n(d) The annual license fee is $1,575.","path":["Article - Alcoholic Beverages and Cannabis"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gab\u0026section=22-805","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:03Z","sha256":"869c7bdba764bb053cfd052f9f4a5ff2df05d816c61f1c925a803a14066f7d3c","source_id":"us-md","stale":false,"prev":"us-md/md.-code-alcoholic-beverages-and-cannabis-22-804","next":"us-md/md.-code-alcoholic-beverages-and-cannabis-22-806"},"notice":"GroundRules: Original legal text.
