Code, Alcoholic Beverages and Cannabis § 23–1602","heading":"","body":"(a) (1) Subject to subsection (b) of this section, the Board may not issue:\n(i) a Class B license for a restaurant that is within 400 feet of the nearest point of a public school building; or\n(ii) any other license for an establishment that is within 500 feet of the nearest point of a public school building.\n(2) A decision of the County Board of Education to locate a public school building within 500 feet of the premises of a license holder may not be the basis to revoke or deny the renewal or transfer of the license.\n(b) For a license issued on or before June 30, 1971, the Board may renew the license or approve the transfer of the license to a new license holder for the same establishment and type of license.","path":["Article - Alcoholic Beverages and Cannabis"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gab\u0026section=23-1602","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:03Z","sha256":"4dabae150391366b95ad6cfd8e374497ef31637287a27b3ae0d6bdfced23fec7","source_id":"us-md","stale":false,"prev":"us-md/md.-code-alcoholic-beverages-and-cannabis-23-1601","next":"us-md/md.-code-alcoholic-beverages-and-cannabis-23-1603"},"notice":"GroundRules: Original legal text.
