Code, Alcoholic Beverages and Cannabis § 26–1304","heading":"","body":"(a) In this section, “Festival” means the Prince George’s County Wine Festival.\n(b) (1) There is a Prince George’s County Wine Festival license.\n(2) The Board may issue one license each year.\n(c) The Board may issue the license to a holder of a retail license, Class 3 winery license, or Class 4 limited winery license.\n(d) The license authorizes the license holder to display and sell wine that is:\n(1) manufactured and processed in any state; and\n(2) distributed in the State when the license application is filed.\n(e) A license holder shall display and sell wine:\n(1) for on– and off–premises consumption; and\n(2) during the hours and days designated for the Festival.\n(f) (1) The Board shall:\n(i) choose a location for the Festival that:\n1. is not in the 24th Legislative District; and\n2. is not already licensed; and\n(ii) ensure that the primary focus of the Festival is the promotion of Maryland wine.\n(2) Subject to paragraph (3) of this subsection, each year the Board may choose 1 weekend, Friday through Sunday, inclusive, for the Festival.\n(3) The weekend chosen for the Festival may not:\n(i) be within 14 days before or after the dates chosen for the Maryland Wine Festival in Carroll County; or\n(ii) conflict with the dates chosen for the:\n1. Anne Arundel County Beer and Wine Festival;\n2. Calvert County Wine Festival;\n3. Charles County Beer and Wine Festival; or\n4. Howard County Wine Festival.\n(g) The license holder may hold another license of a different class or nature.\n(h) Wine displayed and sold shall be:\n(1) invoiced to the license holder by a licensed wholesaler, Class 3 winery, or Class 4 limited winery; and\n(2) delivered to the Festival from the licensed premises of the wholesaler, Class 3 winery, or Class 4 limited winery.\n(i) A holder of a wholesale, Class 3 winery, or Class 4 limited winery license may enter into an agreement with the license holder to:\n(1) deliver wine not earlier than 2 days before the effective date of the license; and\n(2) accept returns not later than 2 days after the expiration date of the license.\n(j) The Board may set the license fee.\n(k) The Board shall adopt regulations to carry out this section.","path":["Article - Alcoholic Beverages and Cannabis"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gab\u0026section=26-1304","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:03Z","sha256":"e560cf3e070034416e5d937366b3796b9f2fadf04bf6f60b39065ac919d5c160","source_id":"us-md","stale":false,"prev":"us-md/md.-code-alcoholic-beverages-and-cannabis-26-1301","next":"us-md/md.-code-alcoholic-beverages-and-cannabis-26-1305"},"notice":"GroundRules: Original legal text.
