Code, Alcoholic Beverages and Cannabis § 26–1516","heading":"","body":"(a) Except as provided in subsection (b) of this section, if a license is denied, another license application for the same location may not be made for 6 months after the denial.\n(b) This section does not apply to:\n(1) an application for the transfer of a license; or\n(2) a license application that is denied:\n(i) because of a legal defect or omission;\n(ii) if the Board expressly states that the denial was directed solely against the applicant and not against the location described in the application; or\n(iii) if, after a hearing, the Board determines that another applicant is better qualified to be a license holder.","path":["Article - Alcoholic Beverages and Cannabis"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gab\u0026section=26-1516","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:03Z","sha256":"20fc0d7e6a82f75ae77f5bd0469237fd0fff3e62927614fabdca2a201f7983b7","source_id":"us-md","stale":false,"prev":"us-md/md.-code-alcoholic-beverages-and-cannabis-26-1515","next":"us-md/md.-code-alcoholic-beverages-and-cannabis-26-1517"},"notice":"GroundRules: Original legal text.
