Code, Alcoholic Beverages and Cannabis § 29–2608","heading":"","body":"(a) Except as provided in subsection (b) of this section, a warrant may not be issued to search a residence unless:\n(1) the residence or part of the residence is used as a store, hotel, restaurant, or boarding house;\n(2) the residence is used as a public resort; or\n(3) the residence is used to keep, hide, or provide alcoholic beverages to sell or for another use that violates the law.\n(b) A judge of the District Court may issue a warrant after determining that the issuance would be proper, based on an examination of:\n(1) the applicant for the warrant; or\n(2) other evidence.","path":["Article - Alcoholic Beverages and Cannabis"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gab\u0026section=29-2608","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:03Z","sha256":"f6a2b27de9680389bbace58b51357230971b746bc17ef098dfc54799daf55206","source_id":"us-md","stale":false,"prev":"us-md/md.-code-alcoholic-beverages-and-cannabis-29-2607","next":"us-md/md.-code-alcoholic-beverages-and-cannabis-29-2609"},"notice":"GroundRules: Original legal text.
