Code, Alcoholic Beverages and Cannabis § 31–2704","heading":"","body":"(a) In this section, “knowingly” means the knowledge a reasonable individual would have under ordinary circumstances based on the habits, appearance, or personal reputation of an individual.\n(b) A license holder or an employee of a license holder may not knowingly sell or provide an alcoholic beverage to a habitual drunkard.\n(c) A license holder who violates this section is guilty of a misdemeanor and on conviction is subject to:\n(1) for a first offense, a fine not exceeding $50; and\n(2) for each subsequent offense, imprisonment not exceeding 30 days or a fine not exceeding $100 or both.","path":["Article - Alcoholic Beverages and Cannabis"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gab\u0026section=31-2704","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:03Z","sha256":"5a1cf4e9002fb528379ca5b032e959eec99d2d2310a08467a19de678b509aa53","source_id":"us-md","stale":false,"prev":"us-md/md.-code-alcoholic-beverages-and-cannabis-31-2703","next":"us-md/md.-code-alcoholic-beverages-and-cannabis-31-2801"},"notice":"GroundRules: Original legal text.
