Code, Alcoholic Beverages and Cannabis § 33–307","heading":"","body":"(a) The Department may establish and maintain stores known as “dispensaries”.\n(b) A dispensary:\n(1) may sell any alcoholic beverage except beer; and\n(2) shall sell alcoholic beverages in a sealed package or container.\n(c) The Department may establish and maintain dispensaries only in:\n(1) Berlin;\n(2) Ocean City;\n(3) Pocomoke City;\n(4) Snow Hill;\n(5) a rural area approved by the Department and the County Commissioners; and\n(6) a housing development that:\n(i) has a population of at least 10,000 individuals;\n(ii) is overseen by a homeowners association; and\n(iii) has a special police force commissioned under Title 3, Subtitle 3 of the Public Safety Article.\n(d) The Department may sell or deliver liquor to a retail license holder from 6 a.m. to midnight Monday through Saturday and from 9 a.m. to 5 p.m. on Sunday.\n(e) A person may not open or consume the contents of a sealed package or container containing alcoholic beverages on the premises of the dispensary where sold.\n(f) Title 4, Subtitle 2 of this article does not apply to this section.","path":["Article - Alcoholic Beverages and Cannabis"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gab\u0026section=33-307","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:03Z","sha256":"98944482d0c9cf057dbd0f2964e9598422f9833fb192b93724838e0566f84d95","source_id":"us-md","stale":false,"prev":"us-md/md.-code-alcoholic-beverages-and-cannabis-33-306","next":"us-md/md.-code-alcoholic-beverages-and-cannabis-33-308"},"notice":"GroundRules: Original legal text.
