Code, Alcoholic Beverages and Cannabis § 36–1104","heading":"","body":"(a) In this section, “tetrahydrocannabinol” has the meaning stated in § 36–1102 of this subtitle.\n(b) A person may not sell or distribute a product containing tetrahydrocannabinol that violates the potency, packaging, or labeling requirements under § 36–203 or § 36–203.1 of this title or any regulations adopted under those sections.\n(c) (1) A person may not sell or distribute a product that is advertised as containing an amount of tetrahydrocannabinol that violates § 36–1102 of this subtitle.\n(2) Advertising under paragraph (1) of this subsection includes packaging, labeling, or electronic communication.\n(d) The Executive Director may seize, destroy, or confiscate a product that is:\n(1) offered or displayed for sale to a consumer in a location that is not appropriately licensed under Subtitle 4 of this title; and\n(2) the subject of a violation under subsection (b) or (c) of this section.\n(e) (1) If a person who is not a cannabis licensee violates subsection (b) or (c) of this section, the person:\n(i) may be charged by a citation; and\n(ii) is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $5,000.\n(2) If a cannabis licensee violates subsection (b) or (c) of this section, the licensee is subject to disciplinary action by the Administration in accordance with § 36–202 of this title.","path":["Article - Alcoholic Beverages and Cannabis"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gab\u0026section=36-1104","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:03Z","sha256":"d7eb56a89a0b352166b83b346a6ba0a1a0cd42fee5e1deb0f5e88cb850984351","source_id":"us-md","stale":false,"prev":"us-md/md.-code-alcoholic-beverages-and-cannabis-36-1103","next":"us-md/md.-code-alcoholic-beverages-and-cannabis-36-1201"},"notice":"GroundRules: Original legal text.
