Code, Alcoholic Beverages and Cannabis § 36–504","heading":"","body":"(a) (1) In this section, “owner” includes any type of owner or beneficiary of a business entity, including a principal officer, a director, a principal employee, a partner, an investor, or a beneficial owner of the business entity and, notwithstanding any other provision of this subtitle, a person having any ownership interest regardless of the percentage of ownership interest.\n(2) “Owner” does not include a stockholder.\n(b) The provisions in this section are in addition to the conflict of interest provisions in Title 5 of the General Provisions Article.\n(c) Except as provided in subsection (d) of this section, a constitutional officer or a secretary of a principal department of the Executive Branch of the State government may not:\n(1) be an owner or an employee of a business entity that holds a license or registration under this title; or\n(2) have an official relationship with a business entity that holds a license or registration under this title.\n(d) Subject to the provisions of Title 5 of the General Provisions Article, a constitutional officer or a secretary of a principal department of the Executive Branch of the State government may remain an owner or an employee of a business entity that holds a license under this title if the constitutional officer or secretary was an owner or employee of the business entity before the constitutional officer’s election or appointment or the secretary’s appointment.\n(e) A member of the General Assembly may not:\n(1) be an owner or an employee of a business entity that holds a license or registration under this title; or\n(2) have an official relationship with a business entity that holds a license or registration under this title.\n(f) A former member of the General Assembly, for the 1–year period immediately after the member leaves office, may not:\n(1) be an owner or an employee of a business entity that holds a license or registration under this title; or\n(2) have an official relationship with a business entity that holds a license or registration under this title.\n(g) An employee of the Administration may not:\n(1) have a direct or indirect financial, ownership, or management interest, including ownership of any stocks, bonds, or other similar financial instruments, in any cannabis licensee;\n(2) have an official relationship with a person who holds a license or registration under this title;\n(3) be an elected official of State or local government;\n(4) receive or share in, directly or indirectly, the receipts or proceeds of a cannabis licensee; or\n(5) have a beneficial interest in a contract for the manufacture or sale of cannabis or the provision of independent consulting services in connection with a cannabis license.","path":["Article - Alcoholic Beverages and Cannabis"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gab\u0026section=36-504","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:03Z","sha256":"16b58d5a2a8c5f335812a87e4b34d0c055911a984c5f3ee9882e144647c2b3a2","source_id":"us-md","stale":false,"prev":"us-md/md.-code-alcoholic-beverages-and-cannabis-36-503","next":"us-md/md.-code-alcoholic-beverages-and-cannabis-36-505"},"notice":"GroundRules: Original legal text.
