Code, Alcoholic Beverages and Cannabis § 4–905","heading":"","body":"(a) On the hearing of a petition under this subtitle, the court shall presume that the action of the local licensing board was proper and best served the public interest.\n(b) A petitioner has the burden of proof to show that the decision of the local licensing board being reviewed was:\n(1) against the public interest; and\n(2) (i) not honestly and fairly arrived at;\n(ii) arbitrary;\n(iii) procured by fraud;\n(iv) unsupported by substantial evidence;\n(v) unreasonable;\n(vi) beyond the powers of the board; or\n(vii) illegal.\n(c) A review of a decision of a local licensing board under this subtitle shall be heard by the court without a jury.\n(d) The court may hear additional testimony to the extent and in the manner that is necessary if, in the opinion of the court:\n(1) it is impracticable to determine the question presented to the court without the hearing of additional evidence;\n(2) a qualified litigant has been deprived of the opportunity to offer evidence; or\n(3) the interests of justice require that further evidence should be taken.","path":["Article - Alcoholic Beverages and Cannabis"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gab\u0026section=4-905","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:03Z","sha256":"81c8e6f4625aafe3c6bacb0adbd72be19d5c2b6d254d8eeda688f8cfb3eddcb8","source_id":"us-md","stale":false,"prev":"us-md/md.-code-alcoholic-beverages-and-cannabis-4-904","next":"us-md/md.-code-alcoholic-beverages-and-cannabis-4-906"},"notice":"GroundRules: Original legal text.
