Code, Alcoholic Beverages and Cannabis § 6–321","heading":"","body":"(a) In this section, “public property” includes property that is:\n(1) a structure, road, parking area, or grounds; and\n(2) located on land owned, leased, or operated by:\n(i) the State;\n(ii) a county;\n(iii) a municipality;\n(iv) the Washington Suburban Sanitary Commission;\n(v) the Maryland–National Capital Park and Planning Commission;\n(vi) the Montgomery County Revenue Authority; or\n(vii) the Washington Metropolitan Area Transit Authority.\n(b) (1) Except as provided in paragraphs (2) and (3) of this subsection, an individual may not consume an alcoholic beverage:\n(i) on public property;\n(ii) on the mall, adjacent parking area, or other outside area of a shopping center;\n(iii) on an adjacent parking area or other outside area of any other retail establishment; and\n(iv) in a parked vehicle located in an area described under item (i), (ii), or (iii) of this paragraph.\n(2) An individual may consume an alcoholic beverage on:\n(i) public property if authorized by the governmental entity that has authority over the property; or\n(ii) private property described under paragraph (1)(ii) through (iv) of this subsection if authorized by the owner of the property.\n(3) If the owner or operator of a motor home or chartered bus has consented to the consumption of the alcoholic beverages, paragraph (1) of this subsection does not apply to passengers:\n(i) in the living quarters of a motor home equipped with a toilet and central heating; or\n(ii) of a chartered bus in transit.\n(c) (1) A violation of this section is a Code violation and a civil offense.\n(2) A person who violates this section:\n(i) shall be issued a citation under § 10–119 of the Criminal Law Article; and\n(ii) is subject to a fine not exceeding $100.","path":["Article - Alcoholic Beverages and Cannabis"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gab\u0026section=6-321","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:03Z","sha256":"d736e3373e7855ae1a06a883d11f1d3004840777bf877eae41206f5cb6a852c9","source_id":"us-md","stale":false,"prev":"us-md/md.-code-alcoholic-beverages-and-cannabis-6-320","next":"us-md/md.-code-alcoholic-beverages-and-cannabis-6-322"},"notice":"GroundRules: Original legal text.
