Code, Business Occupations and Professions § 10–312","heading":"","body":"(a) The trustees appointed under § 10-311 of this subtitle shall:\n(1) receive contributions to the Fund; and\n(2) manage the assets of the Fund.\n(b) To the extent the trustees consider reimbursement proper and reasonable, the trustees may use the Fund to reimburse a person for a loss that was caused by a defalcation of a lawyer if:\n(1) the lawyer caused the loss while acting for the person as an attorney at law or a fiduciary; and\n(2) the person cannot recover the money under a bond.\n(c) The trustees may enforce a claim for restitution arising by subrogation, assignment, or otherwise against any person whose actions gave rise to a claim that the Fund pays.","path":["Article - Business Occupations and Professions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gbo\u0026section=10-312","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:13Z","sha256":"1b7b17bc887253496dcf3cb0bbf098003c7cc690bd93f97d44b7ef8918996eb2","source_id":"us-md","stale":false,"prev":"us-md/md.-code-business-occupations-and-professions-10-311","next":"us-md/md.-code-business-occupations-and-professions-10-313"},"notice":"GroundRules: Original legal text.
