Code, Business Occupations and Professions § 16–707","heading":"","body":"(a) The Commission may impose on a person who violates this title a civil penalty not exceeding $5,000 for each violation, whether or not the person is licensed or holds a certificate under this title.\n(b) In setting the amount of a civil penalty, the Commission shall consider:\n(1) the seriousness of the violation;\n(2) the good faith of the violator;\n(3) any previous violations;\n(4) the harmful effect of the violation on the complainant, the public, and the business of home inspections or real estate appraisals;\n(5) the assets of the violator; and\n(6) any other relevant factors.","path":["Article - Business Occupations and Professions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gbo\u0026section=16-707","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:13Z","sha256":"71f6a6ba9b5edad458c551bbab317b90601a0410cf6017c0356c7a709571e54e","source_id":"us-md","stale":false,"prev":"us-md/md.-code-business-occupations-and-professions-16-706","next":"us-md/md.-code-business-occupations-and-professions-16-801"},"notice":"GroundRules: Original legal text.
