Code, Business Occupations and Professions § 17–322.1","heading":"","body":"(a) For purposes of § 17-322(b) of this subtitle, it is not a material fact relating to property offered for sale or lease that:\n(1) an owner or occupant of the property is, was, or is suspected to be:\n(i) infected with human immunodeficiency virus; or\n(ii) diagnosed with acquired immunodeficiency syndrome; or\n(2) a homicide, suicide, accidental death, natural death, or felony occurred on the property.\n(b) (1) It is not grounds for a disciplinary action against a licensee under this subtitle, that a licensee did not disclose to a prospective purchaser or lessee, a fact contained in subsection (a) of this section.\n(2) A licensee may not be held personally liable for failure to disclose a fact contained in subsection (a) of this section.","path":["Article - Business Occupations and Professions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gbo\u0026section=17-322.1","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:13Z","sha256":"9614b69e0ab267921103aa380f6868373cee0a44246a61c6a26af59643cd7b75","source_id":"us-md","stale":false,"prev":"us-md/md.-code-business-occupations-and-professions-17-322","next":"us-md/md.-code-business-occupations-and-professions-17-323"},"notice":"GroundRules: Original legal text.
