Code, Business Occupations and Professions § 17–613","heading":"","body":"(a) Subject to the provisions of subsection (d) of this section, a person who violates any provision of the following sections of this title is guilty of a misdemeanor and on conviction for a first offense is subject to a fine not exceeding $5,000 or imprisonment not exceeding 1 year or both:\n(1) § 17–502;\n(2) § 17–525;\n(3) § 17–526;\n(4) § 17–527;\n(5) § 17–530;\n(6) § 17–532;\n(7) § 17–601;\n(8) § 17–602;\n(9) § 17–603;\n(10) § 17–604;\n(11) § 17–605;\n(12) § 17–606;\n(13) § 17–607;\n(14) § 17–608;\n(15) § 17–609;\n(16) § 17–610; or\n(17) § 17–611.\n(b) A corporation, partnership, or other association that violates § 17–612 of this subtitle is guilty of a misdemeanor and on conviction is subject to a fine:\n(1) not exceeding $5,000 for a first violation;\n(2) not exceeding $15,000 for a second violation; and\n(3) not exceeding $25,000 for a third or subsequent violation.\n(c) (1) The Commission may impose on a person who violates any provision of this title a penalty not exceeding:\n(i) $5,000 for a first violation;\n(ii) $15,000 for a second violation; and\n(iii) $25,000 for a third or subsequent violation.\n(2) In setting the amount of the penalty, the Board shall consider:\n(i) the seriousness of the violation;\n(ii) the harm caused by the violation;\n(iii) the good faith of the violator;\n(iv) any history of previous violations by the violator; and\n(v) any other relevant factors.\n(3) The Board shall pay any penalty collected under this subsection into the General Fund of the State.\n(d) (1) Any person found guilty of a second violation of any provision of the sections listed in subsection (a) of this section is subject to a fine not exceeding $15,000 or 2 years imprisonment or both.\n(2) Any person found guilty of a third or subsequent violation of any provision of the sections listed in subsection (a) of this section is subject to a fine not exceeding $25,000 or 3 years imprisonment or both.","path":["Article - Business Occupations and Professions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gbo\u0026section=17-613","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:13Z","sha256":"6ce51f9c68813c7b090d6d01fbbc8c65cebaa2cf978a79ab62ad980053d67539","source_id":"us-md","stale":false,"prev":"us-md/md.-code-business-occupations-and-professions-17-612","next":"us-md/md.-code-business-occupations-and-professions-17-614"},"notice":"GroundRules: Original legal text.
