Code, Business Occupations and Professions § 5–315","heading":"","body":"(a) Except as otherwise provided in § 10–226 of the State Government Article, before the Board takes any final action under § 5–314 of this subtitle or § 5–608.1 of this title, it shall give the individual against whom the action is contemplated an opportunity for a hearing before the Board.\n(b) The Board shall give notice and hold the hearing in accordance with Title 10, Subtitle 2 of the State Government Article.\n(c) The hearing notice to be given to the individual shall be served at least 5 days before the hearing.\n(d) The individual may be represented at the hearing by counsel.\n(e) (1) The Board may issue a subpoena for the attendance of a witness to testify or the production of evidence in connection with any proceeding under this section.\n(2) A subpoena issued under this subsection shall be served by:\n(i) certified mail; or\n(ii) the sheriff of the county where the person to be served resides or has a principal place of business.\n(f) If, after due notice, the individual against whom the action is contemplated fails or refuses to appear, nevertheless the Board may hear and determine the matter.","path":["Article - Business Occupations and Professions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gbo\u0026section=5-315","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:13Z","sha256":"d784fd42140d96d29e0ae0de4f2bc640436b607c3adb7b37ddb3ea8121843141","source_id":"us-md","stale":false,"prev":"us-md/md.-code-business-occupations-and-professions-5-314","next":"us-md/md.-code-business-occupations-and-professions-5-316"},"notice":"GroundRules: Original legal text.
