Code, Business Occupations and Professions § 5–523","heading":"","body":"(a) Except as otherwise provided in § 10–226 of the State Government Article, before the Board takes any final action under § 5–509 or § 5–522 of this subtitle or § 5–608.1 of this title, it shall give the person against whom the action is contemplated an opportunity for a hearing before the Board.\n(b) The Board shall give notice and hold the hearing in accordance with Title 10, Subtitle 2 of the State Government Article.\n(c) The hearing notice to be given to the person shall be served at least 5 days before the hearing.\n(d) The person may be represented at the hearing by counsel.\n(e) (1) The Board may issue a subpoena for the attendance of a witness to testify or the production of evidence in connection with any proceeding under this section.\n(2) A subpoena issued under this subsection shall be served by:\n(i) certified mail; or\n(ii) the sheriff of the county where the person to be served resides or has a principal place of business.\n(f) If, after due notice, the person against whom the action is contemplated fails or refuses to appear, nevertheless the Board may hear and determine the matter.","path":["Article - Business Occupations and Professions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gbo\u0026section=5-523","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:13Z","sha256":"54b0b123587e04002cf3cd8e39e6660b1cf152253cb2f94eb0f5abe171b7e2ae","source_id":"us-md","stale":false,"prev":"us-md/md.-code-business-occupations-and-professions-5-522","next":"us-md/md.-code-business-occupations-and-professions-5-524"},"notice":"GroundRules: Original legal text.
