Code, Business Occupations and Professions § 5–609","heading":"","body":"(a) A person who violates any provision of this title is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $100 or imprisonment not exceeding 30 days or both.\n(b) (1) Except as otherwise provided by this title, the Board may impose on a person who violates any provision of this title a penalty not exceeding $1,000 for all violations cited on a single day.\n(2) In setting the amount of the penalty, the Board shall consider:\n(i) the seriousness of the violation;\n(ii) the harm caused by the violation;\n(iii) the good faith of the violator;\n(iv) any history of previous violations by the violator; and\n(v) any other relevant factors.\n(3) The Board shall pay any penalty collected under this subsection into the General Fund of the State.","path":["Article - Business Occupations and Professions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gbo\u0026section=5-609","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:13Z","sha256":"b9ea47a85f1e7fdccacc3c29e64713ea9a37fe289f6493d44cbeba2ff9a283e4","source_id":"us-md","stale":false,"prev":"us-md/md.-code-business-occupations-and-professions-5-608.2","next":"us-md/md.-code-business-occupations-and-professions-5-610"},"notice":"GroundRules: Original legal text.
