Code, Business Occupations and Professions § 6.5–404","heading":"","body":"(a) A person who violates § 6.5-401, § 6.5-402, or § 6.5-403 of this subtitle is guilty of a misdemeanor and on conviction is subject to:\n(1) a fine not exceeding $1,000 or imprisonment not exceeding 6 months or both; and\n(2) on a second or subsequent conviction, a fine not exceeding $5,000 or imprisonment not exceeding 2 years or both.\n(b) (1) Except as otherwise provided by this title, the Board may impose on a person who violates any provision of this title a penalty not exceeding $5,000 for each violation.\n(2) In setting the amount of the penalty, the Board shall consider:\n(i) the seriousness of the violation;\n(ii) the harm caused by the violation;\n(iii) the good faith of the violator;\n(iv) any history of previous violations by the violator; and\n(v) any other relevant factors.\n(3) The Board shall pay any penalty collected under this subsection into the General Fund of the State.","path":["Article - Business Occupations and Professions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gbo\u0026section=6.5-404","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:13Z","sha256":"20d047b50c710696fc09433828b70903fe70cd919eeca00ed213e48676e8fe79","source_id":"us-md","stale":false,"prev":"us-md/md.-code-business-occupations-and-professions-6.5-403","next":"us-md/md.-code-business-occupations-and-professions-6.5-501"},"notice":"GroundRules: Original legal text.
