Code, Business Regulation § 1–412","heading":"","body":"(a) The Secretary of State shall cancel a registration of a mark if:\n(1) the registrant asks that it be canceled;\n(2) the registrant fails to renew it;\n(3) a court of competent jurisdiction orders that it be canceled on any ground; or\n(4) a court of competent jurisdiction finds that:\n(i) the mark is abandoned;\n(ii) the registrant does not own the mark;\n(iii) the registration was granted improperly; or\n(iv) the registration was obtained fraudulently.\n(b) (1) Subject to paragraph (2) of this subsection, the Secretary of State shall cancel the registration of a mark if a court of competent jurisdiction finds the mark to be likely to confuse or deceive because it resembles a mark that:\n(i) was registered by another person in the United States Patent Office before the date the registrant applied for registration under this subtitle; and\n(ii) is not abandoned.\n(2) The Secretary of State may not cancel the registration of a mark if the registrant proves that:\n(i) the registrant holds a concurrent registration of the mark in the United States Patent Office; and\n(ii) the registration in the United States Patent Office covers an area that includes the State.","path":["Article - Business Regulation"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gbr\u0026section=1-412","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:23Z","sha256":"388073be39f51a27992121a166b1ae3510c672761f6466ecc7e47da618f14b5b","source_id":"us-md","stale":false,"prev":"us-md/md.-code-business-regulation-1-411","next":"us-md/md.-code-business-regulation-1-413"},"notice":"GroundRules: Original legal text.
