Code, Business Regulation § 12–502","heading":"","body":"(a) (1) A person who willfully or knowingly violates this title is guilty of a misdemeanor and, on conviction, is subject to a fine not exceeding $10,000 or imprisonment not exceeding 2 years or both.\n(2) Each associate, employee, manager, or partner who participates in or consents to a violation of this title is guilty of a misdemeanor and, on conviction, is subject to a fine not exceeding $5,000 or imprisonment not exceeding 1 year or both.\n(3) Each violation of this title is a separate offense.\n(b) (1) The Secretary may impose on a person who violates any provision of this title a penalty not exceeding $5,000 for each violation.\n(2) In setting the amount of the penalty, the Secretary shall consider:\n(i) the seriousness of the violation;\n(ii) the harm caused by the violation;\n(iii) the good faith of the violator;\n(iv) any history of previous violations by the violator; and\n(v) any other relevant factors.\n(3) The Secretary shall pay any penalty collected under this subsection into the General Fund of the State.","path":["Article - Business Regulation"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gbr\u0026section=12-502","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:23Z","sha256":"5bc78262fbe6b96b0c61b0f841d3dca5bf0a4906f8d38ea130d39c1f4507f0ca","source_id":"us-md","stale":false,"prev":"us-md/md.-code-business-regulation-12-501","next":"us-md/md.-code-business-regulation-12-601"},"notice":"GroundRules: Original legal text.
