Code, Business Regulation § 4–322","heading":"","body":"(a) A person who violates this subtitle is guilty of a misdemeanor and, on conviction, is subject to a fine not exceeding $2,000, six months imprisonment, or both.\n(b) (1) The Commission may impose on a person who violates any provision of this title a penalty not exceeding $5,000 for each violation.\n(2) In setting the amount of the penalty, the Commission shall consider:\n(i) the seriousness of the violation;\n(ii) the harm caused by the violation;\n(iii) the good faith of the violator;\n(iv) any history of previous violations by the violator; and\n(v) any other relevant factors.\n(3) The Commission shall pay any penalty collected under this subsection into the General Fund of the State.","path":["Article - Business Regulation"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gbr\u0026section=4-322","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:23Z","sha256":"9d4020004b9e8a13461e2bcde12225d682d16d4eb9556732774e696f59b90dfc","source_id":"us-md","stale":false,"prev":"us-md/md.-code-business-regulation-4-321","next":"us-md/md.-code-business-regulation-4-323"},"notice":"GroundRules: Original legal text.
