Code, Business Regulation § 4–416","heading":"","body":"(a) Except as otherwise provided in this subtitle and subject to the provisions of § 4-407 of this subtitle, the Secretary may assess a civil penalty against a person who violates any provision of this subtitle not to exceed $25,000.\n(b) To determine the amount of the penalty, the Secretary shall consider:\n(1) the seriousness of the violation;\n(2) the harm caused by the violation;\n(3) the good faith of the violator;\n(4) any history of previous violations by the violator; and\n(5) any other relevant factors.\n(c) The Secretary shall pay any penalty collected under this section into the General Fund of the State.","path":["Article - Business Regulation"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gbr\u0026section=4-416","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:23Z","sha256":"1e6f4d6c71e2cf60b6b464444ca25c0a327be1adec2288df64522ed68cef6412","source_id":"us-md","stale":false,"prev":"us-md/md.-code-business-regulation-4-415","next":"us-md/md.-code-business-regulation-4-417"},"notice":"GroundRules: Original legal text.
