Code, Business Regulation § 5–602","heading":"","body":"(a) This subtitle does not apply to a cemetery that:\n(1) has less than 1 acre available for burial; or\n(2) is owned and operated by:\n(i) a county;\n(ii) a municipal corporation;\n(iii) a church;\n(iv) a synagogue;\n(v) a religious organization;\n(vi) a nonprofit organization created before 1900 by an act of the General Assembly;\n(vii) a family and does not conduct public sales; or\n(viii) a State veterans agency.\n(b) This subtitle does not apply to the sale of a below–ground earth–covered chamber.\n(c) This subtitle does not amend a trust agreement covering a perpetual care fund that existed on or before July 1, 1973, except as to:\n(1) the appointment of a successor trustee or cotrustee;\n(2) deposits into the fund after July 1, 1973; and\n(3) the withdrawal from the fund of income on deposits made after July 1, 1973.","path":["Article - Business Regulation"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gbr\u0026section=5-602","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:23Z","sha256":"14fdae2a15ec9b36a61efec813f4ec1960c50b4e366218e02a3a9f84f6c93bec","source_id":"us-md","stale":false,"prev":"us-md/md.-code-business-regulation-5-601","next":"us-md/md.-code-business-regulation-5-603"},"notice":"GroundRules: Original legal text.
