Code, Business Regulation § 5–605","heading":"","body":"(a) The terms of a trust to provide for perpetual care shall be designated in a written agreement between the registered cemeterian, permit holder, or any other person subject to the trust requirements of this subtitle and trustee.\n(b) The terms of the trust agreement:\n(1) shall conform to this subtitle; and\n(2) may include provisions about:\n(i) payment of income;\n(ii) accumulation of income;\n(iii) reinvestment of income;\n(iv) administration of the trust fund; and\n(v) powers of the trustee as to investments.\n(c) (1) A trust agreement shall be irrevocable.\n(2) However, a trust agreement may:\n(i) give the registered cemeterian, permit holder, or other person subject to the trust requirements of this subtitle the right to remove the trustee and appoint another qualified trustee; and\n(ii) provide for the appointment of individuals as cotrustees and successor cotrustees with a corporate trustee.","path":["Article - Business Regulation"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gbr\u0026section=5-605","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:23Z","sha256":"4c4703d5ca1e3cba9bf7adddb4fe80ace0ca490c9a775f83727266f961b30e24","source_id":"us-md","stale":false,"prev":"us-md/md.-code-business-regulation-5-604","next":"us-md/md.-code-business-regulation-5-606"},"notice":"GroundRules: Original legal text.
