Code, Business Regulation § 7–308","heading":"","body":"(a) Subject to the hearing provisions of § 7–309 of this subtitle, the Board may reprimand a licensee or suspend or revoke a license if the licensee or any owner, director, officer, member, partner, or agent of the licensee:\n(1) makes any material misstatement in an application for a license;\n(2) is convicted under the laws of the United States or of any state of:\n(i) a felony; or\n(ii) a misdemeanor that is directly related to the fitness and qualification of the person to engage in the collection agency business;\n(3) in connection with the collection of any consumer claim:\n(i) commits any fraud; or\n(ii) engages in any illegal or dishonest activities;\n(4) knowingly or negligently violates the Maryland Consumer Debt Collection Act; or\n(5) fails to comply with a lawful order that the Board passes under this title.\n(b) In determining whether to reprimand a licensee or to suspend or revoke a license for a reason described in subsection (a)(2) of this section, the Board shall consider:\n(1) the nature of the crime;\n(2) the relationship of the crime to the activities authorized by the license;\n(3) with respect to a felony, the relevance of the conviction to the fitness and qualification of the licensee to engage in the collection agency business;\n(4) the length of time since the conviction; and\n(5) the behavior and activities of the licensee since the conviction.","path":["Article - Business Regulation"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gbr\u0026section=7-308","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:23Z","sha256":"926cbb6e26442674d9a201372f18d3434792b9805d5006a5515b56718e3e7b2a","source_id":"us-md","stale":false,"prev":"us-md/md.-code-business-regulation-7-307.1","next":"us-md/md.-code-business-regulation-7-309"},"notice":"GroundRules: Original legal text.
