Code, Business Regulation § 9–302","heading":"","body":"An employment agency may not:\n(1) knowingly refer a client to a job if any condition of the job violates any law;\n(2) refer a client to an establishment where a labor dispute exists;\n(3) as a condition of providing service to a client, require the client before acceptance of a job to execute:\n(i) a promissory note; or\n(ii) an instrument with warrant of attorney that authorizes confession of judgment;\n(4) advertise a job for which there is no order by an employer on file;\n(5) send a client to an employer for a job with no order on file for the job unless:\n(i) the employer previously requested regular interviews with qualified clients, the client is qualified, and the employment agency confirms the request before sending the client to the employer; or\n(ii) the employment agency tells the client that the employment agency has no order for the job;\n(6) split a fee with an employer or representative of an employer, except that the employment agency may accept from an employer all or part of a service fee for a client if the employment agency tells the client of the payment;\n(7) charge a client a registration fee or collect in advance from a client a payment for service to be performed for the client to obtain employment;\n(8) publish or cause to be published any false, fraudulent, or misleading information or promise;\n(9) solicit for other employment an individual who is employed by an employer with whom the employment agency placed the individual, unless the individual reactivates the application;\n(10) engage in fraud or dishonest dealing; or\n(11) violate this title.","path":["Article - Business Regulation"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gbr\u0026section=9-302","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:23Z","sha256":"40f301638e2c44e6fa74dd2f0c01bac3974f99a2deb898879e4b5ebb1d962643","source_id":"us-md","stale":false,"prev":"us-md/md.-code-business-regulation-9-102","next":"us-md/md.-code-business-regulation-9-303"},"notice":"GroundRules: Original legal text.
