Code, Commercial Law § 11–5A–02","heading":"","body":"(a) This section does not apply to an individual who produces unpackaged cigarettes for the individual’s consumption by using:\n(1) A mechanical rolling machine; or\n(2) A hand rolling device or procedure.\n(b) Notwithstanding any other provision of law, a retailer or vending machine operator may not purchase from a tobacco product manufacturer or sell, resell, distribute, dispense, or give away to any person an unpackaged cigarette.\n(c) Notwithstanding any other provision of law, a wholesaler may not sell, resell, distribute, dispense, or give away to any person in this State an unpackaged cigarette.\n(d) In addition to any other penalties provided by law, a person who violates this section is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $500 or imprisonment not exceeding 3 months or both.","path":["Article - Commercial Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcl\u0026section=11-5A-02","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:33Z","sha256":"2fe67eb2a5003a89ca998666d4b824a9c8a15b337649f3c3ac037f7a4f4991e6","source_id":"us-md","stale":false,"prev":"us-md/md.-code-commercial-law-11-5a-01","next":"us-md/md.-code-commercial-law-11-5a-03"},"notice":"GroundRules: Original legal text.
