Code, Commercial Law § 12–1302","heading":"","body":"(a) This subtitle applies to any lender that makes a mortgage loan secured by owner–occupied residential real property located in the State.\n(b) This subtitle does not apply to:\n(1) A secondary mortgage loan;\n(2) An open–end or revolving home equity line of credit;\n(3) A construction loan;\n(4) An individual who takes back a deferred purchase money mortgage in connection with the sale of residential real property owned by, and titled in the name of, the individual; or\n(5) An individual who makes a mortgage loan to a borrower who is the individual’s spouse, child, child’s spouse, parent, sibling, grandparent, grandchild, or grandchild’s spouse.","path":["Article - Commercial Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcl\u0026section=12-1302","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:33Z","sha256":"e67aa0ce6740df9a202b262b227cd70c3d964cf93d0fb39cdab26db051fa58fe","source_id":"us-md","stale":false,"prev":"us-md/md.-code-commercial-law-12-1301","next":"us-md/md.-code-commercial-law-12-1303"},"notice":"GroundRules: Original legal text.
