Code, Commercial Law § 12–1504","heading":"","body":"A provider of earned wage access may not:\n(1) Share with an employer any fees, tips, or other charges received from a consumer for earned wage access;\n(2) Condition a consumer’s ability to obtain earned wage access on the consumer’s ability or willingness to pay the provider a tip;\n(3) Charge a consumer a late fee, interest, or other penalty for failure to pay any proceeds, fees, or tips;\n(4) Report any information about a consumer’s failure to pay any proceeds, fees, or tips to any consumer reporting agency;\n(5) Obtain a consumer’s credit report as a method of qualifying the consumer for earned wage access;\n(6) Receive interest from a consumer; or\n(7) Compel or attempt to compel payment by a consumer of any proceeds, fees, tips, gratuities, or other donations through:\n(i) A civil action against the consumer;\n(ii) The use of a third party to pursue collection from the consumer on the provider’s behalf; or\n(iii) The sale or assignment of outstanding amounts to a third–party collector or debt buyer for collection from the consumer.","path":["Article - Commercial Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcl\u0026section=12-1504","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:33Z","sha256":"72cc2a59b883270062e40d2426c79b2966279bfabf1168ea8d27b1d1de545281","source_id":"us-md","stale":false,"prev":"us-md/md.-code-commercial-law-12-1503","next":"us-md/md.-code-commercial-law-12-1505"},"notice":"GroundRules: Original legal text.
